The purpose of the work is to develop the concept, ways and means of updating the existing methodological tools of the RMPD in the Ukrainian water legislation. Analysis of the legal directions and features of updating the Ukrainian regulation of the discharge of polluting substances in the draft Instructions. Results of the work – The regulatory features of the environmental and legal sub-institute of the RMPDP as a separate object in the water legislation of Ukraine and in the environmental legislation of the EU have been revealed. The main environmental tool of the RMPDP was considered and studied: the mixing zone (MZ) of pollutants in return water with receiving water of surface water bodies. The characteristics of MZ as operational regulators that determine the norms of MPD have been studied. The implementation of the RMP for Ukrainian water legislation has been developed and proposed, which is provided in the draft regulatory act: "Instructions on the procedure for developing standards for the maximum permissible discharge of pollutants into water bodies" (first edition).
