The subject of the study is criminal liability for the creation of a criminal organization or criminal community and participation in them: problems of theory and practice.
The main tasks of the research work are determined taking into account the specifics of the purpose and subject of the research:
the thieves' community as a form of organized crime was investigated; the novelties of criminal legislation on combating organized crime from June 4, 2020 were analyzed; the features of a criminal organization and a criminal community as forms of complicity were highlighted; The objective and subjective features of the crime provided for in Article 255 of the Criminal Code of Ukraine are revealed; the qualifying and especially qualifying features of the creation, leadership of a criminal community or criminal organization, as well as participation in it are outlined; the grounds for exemption from criminal liability for participation in a criminal organization are considered; the punishment for the creation, leadership of a criminal community or criminal organization, as well as participation in it is characterized.
