В. М. Корецького Description Дисертацію присвячено проблемам правового регулювання майнової відповідальності за порушення лісового законодавства. У роботі досліджуються поняття, підстави та юридична природа майнової відповідальності за порушення лісового законодавства, розглядаються сутність, особливості й способи обчислення шкоди, яка завдається такими порушеннями. Докладно аналізується механізм застосування майнової відповідальності за порушення лісового законодавства. Сформовано систему показників і критеріїв для оцінки ефективності цього механізму. Обґрунтовано низку пропозицій щодо внесення змін і доповнень до законодавства, яке регулює порядок притягнення порушників лісового законодавства до майнової відповідальності. Зроблено висновок про необхідність організаційних змін у структурі органів управління лісовим господарством та реформування системи розподілу і використання коштів, отриманих за позовами про відшкодування шкоди, заподіяної порушеннями лісового законодавства. The paper is devoted to the problems of legal regulation of the property liability for the breach of forest legislation. The terms, causes and legal nature of property liability for the breach of forest legislation are investigated in the dissertation; essence, peculiarities and assessment methods of detriment, caused by such breaches are examined. The application mechanism of property liability for the breach of forest legislation is analyzed in detail. It was formed the system of indexes and criteria of the effectiveness of this mechanism. It was grounded the range of propositions, concerning the changes and amendments to the legislation, regulating the order of imposing property liability for the breach of forest legislation. It was made the conclusion about the necessity of organizational changes in the structure of Governmental Bodies of Forest Economy, and using damages, caused by the breach of forest legislation. popup.nrat_date 2025-03-24 Close
