 The main purpose of the study was to update the theoretical foundations of the legal regulation of the right of municipal property in Ukraine and the formation of appropriate legislative proposals. The following research objectives were set: - to analyze modern scientific interpretations of the right of municipal property based on domestic and foreign scientific research and standards; - to identify the needs of territorial communities in the legal provision of management processes and protection of the right of municipal property - to analyze the system of modern guarantees for exercising the right to municipal property in Ukraine; - to consider the latest changes in the current legislation on the relations in the process of local self-government reforms, as well as European standards for the organization of local self-government; - to modernize the general theoretical and sectoral criteria and indicators of the effectiveness of management of municipal property assets and from this perspective to analyze the level of effectiveness of the use of the movable and immovable property of territorial communities; - based on the previous legislative developments of the Scientific Research Institute of State Building and Local Government of the NALS of Ukraine on the modernization of the Constitution of Ukraine, to provide scientific support for the undertakings of the Legal Reform Commission. As a result of the research the main approaches to the interpretation of the phenomenon and the concept of the right of communal (municipal) property were analyzed; the author's approach was substantiated; clear separation of powers of local authorities in the management of the communal property was proposed; individual grounds for the acquisition of ownership by the territorial community were characterized; the experience of reforming the right of municipal property in the European Union member states was analyzed.
