The aim is to summarize the legislation of Ukraine and foreign countries, judicial practice and theoretical development directions and ways of optimization (simplification, improvement of procedures) trial to the introduction of modern forms of procedural protection of private rights of individuals and businesses and develop on the basis of this research-based recommendations and appropriate amendments to the legislation of Ukraine. Methods - general and special methods of scientific knowledge, including comparative legal and formal-legal methods, and the methods of analysis and synthesis, abstraction and generalization. Results of the study are to develop ways of improvement of the legal mechanism for the introduction of modern forms of procedural protection of private rights of individuals and legal entities in Ukraine and CIS countries, as well as developing the necessary theoretical basis for good law enforcement practices.
