Among the internal system legal backgrounds is nonfulfilment by the legislators the priniciples of criminalization; among the external system legal backgrounds of the impementation of criminal infraction is the postive expirience of the differentiation of criminal action in continental legal systems. The features of proposed type of criminal infraction, which distinguish this type of penal action from a crime and administrative offence, are shown. The system of notions of the impleemntation of the institute of the criminal infraction is elaborated.
