The object of research is the social and legal relations that have developed in the field of customs law enforcement activities to improve the system of organizational and legal measures to combat smuggling and other customs offenses. The aim is to develop proposals to increase the institutional capacity in the field of customs law enforcement to improve the system of combating smuggling and other customs offenses. Research methods: analysis and synthesis, deduction and induction, generalization, abstraction, dialectical cognition; historical analysis; comparative legal analysis; SWOT analysis; graphic and tabular methods. The historical principles of application of operative-search measures in the system of counteraction and prevention of violations of the customs legislation are investigated; the foreign experience of functioning of the bodies authorized to apply measures of operative-search activity in the system of counteraction to smuggling and illegal movement of goods across the customs border is analyzed; the practice of application of measures of operative-search activity of customs bodies in the conditions of their institutional formation is studied; the main advantages of application of operative-search measures by customs bodies in counteraction to customs offenses are defined.
