Head Yakoviuk Ivan V., Доктор юридичних наук Registration Date 02-12-2024 Organization Yaroslav Mudryi National law university popup.description1 The aim of the project is to study the state of theoretical and practical problems of legal (primarily criminal and international) assessment of collaboration with the occupier in the context of ongoing armed conflict in Ukraine and to develop a concept of law policy on collaborationism and collaboration with illegal armed groups in Ukraine in order to guarantee the rights of residents of these territories and the prospect of their reintegration. popup.description2  For the first time in Ukraine and in the world, collaborationism is comprehensively examined from several perspectives – social conflictology, history, international law, criminal law, and human rights law. For the first time, the social and historical dimensions of collaboration are projected onto the legal plane, a detailed criminal law description of all forms of collaboration is provided, a large-scale analysis of case law under Article 111-1 CC is conducted, and the criminalization of denying aggression/occupation is substantiated. A classification of collaboration has been improved, and its features have been generalized (lex lata and ferenda). Provisions were developed on: consideration and significance of combatant immunity, compatibility of collaboration, transitional justice and reintegration processes, mechanisms for guaranteeing human rights in the prosecution of collaboration.
