Registration Date 02-12-2024 Organization Research Institute for the Study of Crime Problems named by Academician V.V.. Stashis of the National Academy of Legal Sciences of Ukraine popup.description1 To promote comprehensive protection of human rights, restoration of peace and sustainable development on the basis of a fair and effective justice system in the post-war period by developing a concept of transitional justice for Ukraine and a theoretical model of its implementation mechanism. popup.description2  The project is an in-depth theoretical and applied study of the problems of human rights protection in the process of social transition from a state of armed conflict to peace. The conducted research made it possible to find out that transitional justice for Ukraine will include all the usual components of this practice: 1) holding those responsible for human rights violations accountable; 2) establishing historical truth; 3) reparation for the harm caused; 4) institutional reforms aimed at preventing the recurrence of the conflict. The criminogenic risks of implementing transitional justice will combine both some ordinary, pre-war etiology factors (and their complexes) of crime, and factors of two qualitatively new groups: a) war-related factors; b) determinants associated with post-war stabilization and restoration activities, both in the humanitarian sphere and in politics, economics, housing and communal services, etc. Deficiencies were identified and proposals were made to improve a number of provisions of the current criminal legislation in terms of liability for crimes against humanity, waging an aggressive war, taking into account international standards. A wide format of victimization of the population of Ukraine was demonstrated. It was established that material compensation requires a narrowed legal and dogmatic approach with a link to criminal proceedings. At the same time, restitution and satisfaction should cover all categories of victims, create an opportunity for perpetuation and respect for memory. Directions for institutional reform were proposed, based on the specifics of the Russian-Ukrainian war. Product Description popup.authors Alina V. Kalinina Klepka Daria I. Maksym H.
