The object of the scientific research is social relations that arise in the process of qualification and investigation of war crimes. The subject of the scientific research is the qualification and investigation of violations of the laws and customs of war. The main tasks of the scientific research are determined taking into account the specifics of the purpose and subject of the research: – to investigate the state of regulatory, legal and scientific and methodological support for the qualification and investigation of certain types of crimes provided for in Article 438 of the Criminal Code of Ukraine; – to outline the objective and subjective features of certain types of crimes provided for in Article 438 of the Criminal Code of Ukraine; – to consider the general provisions of international humanitarian law; – formulate proposals for domestic practice; – identify areas for improving the use of tactical techniques in the investigation of certain types of crimes, provided for in Article 438 of the Criminal Code of Ukraine; – identify proposals for improving the investigation of certain types of crimes, provided for in Article 438 of the Criminal Code of Ukraine; – identify the main problems of proving in cases of war crimes, in particular regarding the collection, recording and evaluation of evidence; Results obtained: methodological recommendations were prepared on the issues of qualification and investigation of a crime provided for in Article 438 of the Criminal Code of Ukraine.
