The object of the study is the social legal relations that arise in the process of conducting special criminal proceedings and criminal proceedings in absentia, related to ensuring the rights and freedoms of the individual in accordance with the standards of the Convention for the Protection of Human Rights and Fundamental Freedoms. The subject of the study is the legal positions of the European Court of Human Rights on proceedings in absentia, which are subject to application during the conduct of special criminal proceedings. The main tasks of the research work are determined taking into account the specifics of the purpose and subject of the study: to analyze the general provisions of special pre-trial investigation and special judicial proceedings; to consider the general principles of applying the practice of the ECHR during criminal proceedings; to establish the subjects of application of the practice of the European Court of Human Rights in criminal proceedings; to consider the legal positions of the European Court of Human Rights on regulatory regulation and the application of the in absentia procedure; to outline the features of the use of the practice of the European Court of Human Rights by pre-trial investigation bodies during the conduct of a special pre-trial investigation. Results obtained: methodological recommendations were prepared on the current issues of applying the practice of the European Court of Human Rights in criminal proceedings in absentia.
