Статья посвящена исследованию отдельных аспектов становления, функционирования и развития системы частного исполнения судебных решений за рубежом, особенностей внедрения института частного исполнителя в Украине, проблемных аспектов внедрения в Украине частного исполнения судебных решений и эффективности реформирования указанной системы. Given the existing permanent political crisis, difficult economic situation, unsatisfactory general level of functioning of executive and judiciary authorities in Ukraine, we should not expect the significant improvement in the enforcement of court judgments, relying solely on the system of public authorities. As for our country, it should be noted that in Ukraine the idea of introduction of the institute of private enforcement officers was offered long ago and it is the subject of scientific debate. Recently, the President submitted to the Verkhovna Rada of Ukraine the draft law on agencies and persons engaged in the enforcement of judgments and decisions of other agencies. This draft law provides for introduction in Ukraine of a new institution - private enforcement officers enforcing the decisions of courts and other authorities as an alternative to the state executive service, and specifies requirements for private enforcement officers, their admission to the profession, control and specifics of their activities. This institution operates in many countries of Eastern and Western Europe and some former Soviet countries. Its effectiveness is demonstrated by the facts that none of the countries, which moved to the private form of enforcement or introduced it as an alternative to state enforcement officers, did not return to the old system. After studying the various forms of enforcement of judgments, we consider it more appropriate to introduce in Ukraine the institution of private enforcement officers by the example of the French model.
