Визначено, що розпорядження товарами, зверненими в державну власність на підставі судового акта, здійснюється шляхом їх реалізації, знищення або утилізації в порядку, встановленому законодавством. Проаналізовано основні нормативно-правові акти, що врегульовують питання розпорядження майном, що перейшло у власність держави за порушення митного законодавства в досліджуваних країнах. Особливу увагу приділено вивченню порядку застосування митної процедури знищення та митної процедури відмови на користь держави. The article examines the procedure for disposal of property, which became the property of the state for violation of customs legislation in the Eurasian Economic Union, namely, in the Russian Federation and the Republic of Belarus. It is determined that disposal of goods, which are converted into state property on the basis of a judicial act, is carried out by means of their realization, destruction or utilization in accordance with the procedure established by the legislation. The basic normative-legal acts regulating the issue of disposal of property, which became the property of the state for violation of customs legislation in the studied countries, are analyzed. Particular attention is paid to the study of the procedure for the application of the customs procedure for destruction and the customs procedure for refusal in favor of the state. popup.nrat_date 2024-04-05 Close
