На підставі результатів аналізу думок українських науковців досліджено, що передумовою криміналізації діянь є історичні; соціальні (соціально-правові та соціально-економічні); медичні; кримінально-правові; кримінологічні; міжнародно-правові фактори. Доведено, що саме ці фактори зумовлюють кримінальну відповідальність злочинів проти здоров’я особи. The author of the article has investigated the meanings and role of the socio-legal conditionality of the criminal law prohibition of an act under Art. 143 of the Criminal Code of Ukraine. Based on the results of the analysis of the opinions of Ukrainian scholars, it is investigated that the precondition for criminalization of acts are historical; social (socio-legal and socio-economic); medical; criminal law; criminological; international legal factors.
