Однією із характерних рис права Київської Русі була традиційність: у текстах русько-візантійських договорів Х ст. поряд із суто візантійськими нормами були відображені і руські правові звичаї. У кінці Х ст. Русь приймає християнство у візантійському варіанті, що викликало появу нового інституту – церкви. Об`єктивно візантійський правовий масив становив джерелом для запозичення. Публічно-правова сфера (особливо, кримінально-правова) Русі була принципово відмінною і ґрунтувалась на місцевому праві.
