Для вирішення цієї проблеми у правовому регулюванні перерахунку пенсій працівників прокуратури в статті запропоновано удосконалити законодавство: передбачити на законодавчому рівні, що на час відсутності документу, який регулює умови та порядок перерахунку пенсій, призначених працівникам прокуратури, перерахунок пенсій працівникам прокуратури необхідно здійснювати на умовах і в порядку, визначеному Законом України «Про пенсійне забезпечення осіб, звільнених з військової служби, та деяких інших осіб». The article emphasizes the lack of a mechanism for the implementation of the legislative norm violates a person's right to retirement (including a recalculation of a pension) because makes it impossible for the actual realization of rights established by regulatory acts. For the solution of this problem in the legal regulation of recalculation of pensions of employees of the prosecutor's office the article proposes to improve the legislation: to provide at the legislative level that on the absence of a document that regulates the conditions and procedure for the recalculation of pensions employees of the prosecutor's office, the recalculation of pensions for employees of the prosecutor's office must be carried out on conditions and in the manner prescribed by the Law of Ukraine "On Pension Provision of Persons, released from military service, and some other persons ". popup.nrat_date 2025-03-24 Close
