Зокрема, аналізується вплив низки чинників, як-от розвиток суспільних відносин та пов’язаний із цим розвиток національної правової системи і системи права на тлі розбудови незалежної української держави. Автором встановлено, що митне законодавство перебуває в пострадянському «фарватері» правового нігілізму та декларативності права, потребує належного наукового обґрунтування. Також встановлено, що на формування понятійного апарату митного права України впливає зв’язок з адміністративним правом України, що має як позитивний, так і негативний аспекти. The article is devoted to researching of theoretically and law peculiarities of forming of conceptual apparatus of Customs Law of Ukraine. Partcularly, the affect of the raw of such factors as development of public relations and related with them development of National Legal System and National System of Law are analyzed on the background of development of Independent Ukrainian State. There is identified that Customs Law is in the post-Soviet “fairway” of law nihilism and declaration of law, and needs actual scientific justification. However, there is determined that forming of conceptual apparatus of Customs Law of Ukraine is influenced by relationship with Administrative Law of Ukraine.
