Зазначено можливість застосування судових рішень Європейського суду з прав людини в судочинстві України. Визначено поняття, основні класифікації судових прецедентів, а також особливості їх застосування. Сформульовано аргументи, які дали змогу зробити висновки та визначити переваги й недоліки застосування судового прецеденту. The article considers the legal nature of case law in the countries of Anglo-American and continental law, the history of precedent as a source of law. The possibility of applying the court decisions of the European Court of Human Rights in the proceedings of Ukraine is indicated. The concepts, basic classifications of court precedents, and also features of their application are defined.
