Відходячи від поширеного розуміння припинення суб’єктивного цивільного права як припинення його належності певній особі, автор пропонує альтернативний погляд на підняту проблему. Самостійний характер відповідного юридичного феномену детермінує необхідність визначення сутності його припинення як елемента правової реальності. У зв’язку з цим таке припинення не завжди є тотожним припиненню стану належності суб’єктивного цивільного визначеній особі. The article is devoted to defining the essence of termination of subjective civil law as a legal possibility of the relevant person provided by the norms of civil law of Ukraine. Departing from the common understanding of the termination of subjective civil law as the termination of its belonging to a certain person, the author offers an alternative view of the problem raised. The independent nature of the relevant legal phenomenon determines the need to determine the essence of its termination as an element of legal reality. Therefore, such termination is not always identical to the termination of the subjective civil status of a particular person. popup.nrat_date 2025-03-24 Close
