The purpose of the study is to analyze and determine the status, trends and possible ways to improve national intellectual property legislation, pharmaceutical legislation, and legislation in the field of health care through the prism of ensuring the policy of state protectionism in relation to the national manufacturer of medicines. The conditions, factors and social institutions that influence the development of local production of medicines both in Ukraine and in the world are identified. The effectiveness of the legal mechanisms available in international law and national legislation for expanding access to medicines through the mechanisms of intellectual property rights is investigated and determined. The author investigates the existing cross-sectoral problems of correlation between the regulation of intellectual property and legal regulation of the market of medicines and vaccines, and the formation of innovative infrastructure for local production of medicines and vaccines, and identifies the conceptual framework for their solution based on the peculiarities of the intellectual property sphere and the nature of social relations arising in the process of creation, protection, use and enforcement of intellectual property rights in the field of pharmacy and medicine. The study resulted in the formulation of theoretical provisions and conceptual approaches that should be taken into account in the process of further adaptation and implementation of Ukrainian legislation to the norms of European legislation in the field of intellectual property in the aspect of biological safety in the field of pharmacy.
